A First Look at Revoking Education Opportunities for NC Extralegals

Having taught English-as-a-Second-Language (ESL) students for the past two years on the Tex-Mex border town of Brownsville, the national trend toward limiting the futures and opportunities of immigrant students hurts me deeply. Many of my freshman ESL students earned a commended performance on this year’s challenging state reading/writing test. Students like these hard-working, highly-motivated immigrant students need to be given the opportunity to be productive citizens and use their array of gifts to make our nation a better place. It is in everyone’s interest to educate and enable every resident within American borders. It is because this first-hand experience with Mexican American immigrants that the North Carolina’s Attorney General’s decision struck me so deeply.

On May 13, 2008, the North Carolina Attorney General’s Office overturned a policy adopted in 2007 which enabled undocumented immigrants with a high-school diploma to gain admission to the fifty-eight colleges within that state. North Carolina’s community college system, the third largest in the country, currently enrolls more than 800,000 students annually (Waggoner, Martha). With the new policy, undocumented immigrants will no longer be allowed to pay out-of-state tuition to work towards an associate’s degree, although this recent ruling does not immediately affect English-as-a-Second-Language (ESL), GED, or continuing-education classes(Mills, Jeff).

Retired community college system president Martin Lancaster was disappointed with the recent ruling, stating, “I believe that every North Carolinian, everyone residing in our state who will ultimately become a part of our work force, should be educated” (Waggoner, Martha). Martin Nadelman, President of Alamance Community College, said, “Personally, I think if you’re permitted to go to public schools you ought to be able to continue your education past high school…I hate to see them not be able to go higher and better themselves” (Mills, Jeff). Rep. George Cleveland, a Republican sponsor of a bill designed to further bar undocumented immigrants from all college programs including ESL and continuing education classes, commented that, “”They’re illegal. It’s as simple as that…[t]he state should be doing anything it can to discourage illegal aliens from being in the state” (Illegal immigrant curbs may fail).

When the North Carolina Community College System first barred illegal immigrants from higher education in 2001, they were the first statewide system to do so. This prohibitive legislation was only briefly overturned from November 2007 until May 2008. According to the Raleigh-based Civitas think-tank analysis of U.S. Census data, nearly 10,000 undocumented immigrant students will be affected by this reversal of enrollment eligibility (Taylor, Jameson).

In three years, many of my 140 freshman students will be walking across the graduation stage in Brownsville, Texas. I will be there in the audience, clutching my newly-received graduation cap from the University of Minnesota School of Law and wondering where these bright young adults will be studying the following year. I hope that our nation has decided to invest in every mind of every child in the United States in pro-education and pro-immigrant bills such as the DreamAct (co-sponsored by Barack Obama). It is our hope that North Carolina acts alone in denying students the opportunity to study simply because of a lack of documentation, and that in three years’ time immigrant students will be afforded the chance to pursue their full potential in our nation’s institutions of higher learning.

Quinceaneras and Coming of Age as a Mexican-American

It is hard for my students to understand that Mexican is a dirty word in some stretches of middle America. Here in Brownsville, most of my freshman prefer Mexico to the United States in terms of life – not living standards, not poverty level, not economic potential or educational excellence, but vida life. Many of my high-school children do not understand why Brownsville is so quiet at night, why no one walks the streets after dark, why there are so many cul-de-sacs and so few nightclubs. Though they complain that Matamoros always floods after rain, these 14 and 15-year-olds prefer its untidy reality to the American sprawl they see in the strip malls and the vacant 30-story hotels in Brownsville’s historic downtown.

The wall proposed for the Rio Grande Valley and, locally, between Matamoros and Brownsville, would force my students to make a choice they should never have to make – between their cultural past and their economic future. The Secure Fence Act is selective division, and while none of us want a similar wall with Canada or on our Atlantic beach front, the wall seems to be a pointed affront to Latino culture. A border wall through la frontera here in Texas would make the hyphen between Mexican-American more like a minus sign than a symbol of cohesion.

Each xenophobic nativist and any anti-Mexican Minuteman would surely change his/her mind about a Mexican border wall if only they were invited to a quinceanera. This past Saturday I had the profound privilege to attend a the fifteenth-birthday celebration of one of my freshman ESL students. As is a rite of passage when driving in Mexico, my fiance and I got hopelessly lost. Every person we spoke to was very understanding of our direction-less driving, as well as the green coolant leaking out of my tired ’94 Dodge Spirit. Finally, we followed a kindly man and his wife to the Salon de Santa Fe.

Although we missed the religious ceremonies at La Iglesia San Juan de los Lagos, I was immediately struck by the profound meaning of the quinceanera. It was a beautiful event, less like a Sweet Sixteen birthday party and more like a full-blown wedding. Each table had elaborate floral arrangements, hors d’oeuvres, and decorations. We were escorted to our table by the mother of my English-as-a-Second-Language student. She speaks no English, but she is entrusting me and my fellow American teachers with her daughter’s education every week. Her daughter Vero leaves their Mexican house on Sunday evening, not to return until Friday night. Her mom can visit Vero on a day-visa, but she would be outside of the law if she tried to make a permanent residence north of the Rio Grande. Vero is torn between her mother’s love and her aptitude for academics, and so she makes the long trip across the narrow river every week. And all this at fifteen years old.

I beam with pride to see my young student say goodbye to childhood through several dances with her father, her tios, and her childhood boy friends. The Vero who waltzes with her father is the same Vero who aces my vocabulary tests in English. The same girl who giggles and screams unabashedly as she pulls out a kitten from her giant birthday box is the same staid student who always is on time, always helps others, always gives her all. The same girl going table to table to thank all her family friends of Mexico is the same Vero who blesses her newfound American community by volunteering many hours each month.

La frontera is more than just the last home for endangered animals like the ocelot and Sonoran Pronghorn; this borderland is also one of the few places in the United States that celebrates quinceaneras. The quinceanera is a proud moment where a girls’ entire community is able to affirm her life and celebrate her maturation into womanhood. It speaks to the best in Mexican culture. As we snack on avocados and pickled peppers and watch a slide show of her life, I wish all America could witness this beautiful celebration. Dancing cumbias and salsas alongside my students and their vecinos, singing corridos and romanticos with grandmothers and granddaughters, I realize this culture calls out the best in family. The world would do well to look to the Mexican mode of making events significant. In 2007, the Catholic Church officially recognized this profound event with its own liturgy; America and all people of faith could learn a lot about community from this Mexican tradition.

(Quinceanera Liturgy)

Driving back across the Mexican-American border checkpoint on the international bridge, past the barbed wire and racial profiling, past the sniffing dogs and warning signs, I ponder why anyone would want to wall off the culture of quinceaneras. While the United States is busy enacting bills like the REAL ID Act and the Secure Fence Act, students like Vero will continue coming of age in a multi-cultural community which is best when it learns from all its immigrants.

A Strange Saint Patrick’s Day

    This St. Patrick’s Day is markedly different than all others past. I came to school today not clad in traditional green, but wearing overalls and a plain white t-shirt. Ringing in my ears were not the Gaelic jigs and Celtic reels but rather the worker chants and the pro-immigrant songs we sang over the past nine days’ march from Roma to Brownsville. I thought less today about the military Molly Maguire’s and their violent fight for worker’s rights and instead meditated on Cesar Chavez’s fasts for his people and Martin Luther King’s words of empowerment and hope. Today was less about nationalism and more about opposing nativism, less about drinking beer and more about living in such a way as to forward the cause of the immigrant, wherever he or she may originate.

    My great-great grandparents came from County Mayo, Sligo, and County Cork. They came to escape the ravages of the potato blight and the resulting famines. They came seeking a better life, and they found it buried deep in the coal mines of Pennsylvania. Towns like Carbondale and Mauch Chunk welcomed them and buried them in their strip-mined hillsides. But, as is always the case with immigrants, they managed to survive and hew out a life for themselves in this America they helped create.

    It was their backs that fed coal into the iron-horses which shrank this vast country into a two-day trip. It was their leadership and collective bargaining powers which scared groups like the Know-Nothings, the first political party formed with the aim of opposing a specific immigrant group. They were able to overcome religious persecution, employer discrimination, and widespread xenophobia to become rightful heirs of the American dream.

 

    This past week, walking alongside many Mexicans and Mexican-Americans, I was reminded of the Batalia de San Patricio, the group of Irish soldiers who defected to the Mexican Army during the Mexican-American War. There was and is so many similarities between those Irish immigrants of yesteryear and the immigrants of today. Both groups rely heavily on their faith in a God who champions the cause of the poor and the sojourner. Both of these immigrants focus on family values and a strong work ethic. Both the Irish of the late 1800s and the Mexicans of the early 21st century are immigrant groups which are being slandered for their desire to come to this land for a better life. News about both of these groups has centered on an “invasion” or any number of natural disaster metaphors such as “flood of immigrants,” “drain on the economy,” and “wave after wave of workers.” None of these nativist metaphors are new – no, they have been around since people first started emigrating to new lands. It is this brand of hateful rhetoric that spurred the command in Leviticus 19:34, “The stranger who sojourns with you shall be as the native among you, and you shall love the stranger as yourself; for you were strangers in the land of Egypt.”

 

 

    As I teach my class today, I am standing in front of them not as a college graduate, a son of Pennsylvania, a Texas-certified teacher, or a social activist. I stand before them in overalls and my walking shoes as the son of immigrants. There is a solidarity here which we must not deny. I do not believe in otherness; if we believe that every man, woman, and child bears the indelible image of God and the spark of the divine, we can never separate ourselves from one another. We are inextricably caught up in an “inescapable network of mutuality, tied up in a single garment of destiny,” and that means that “Injustice anywhere is a threat to justice everywhere.” As King also stated, “Our lives begin to end the day we become silent about things that matter;” this happens for the sheer fact that in not speaking up for the rights of others we are not speaking up for the rights of ourselves and future generations.

    To all those immigrants, past, present and future, I impart this traditional Irish blessing: “Céad míle fáilte romhat!” or “A hundred thousand welcomes to you.”
