The State of Immigration

            Around the world, the state of immigration is in a period of flux.  As most countries today have set boundaries and centralized governments, and as technology has facilitated easy communications and travel between once-distant societies, immigration is on the rise and with it, a rise in both pro-migrant and in anti-immigrant sentiments.  The state of immigrants globally ranges from the welcoming economy of Spain and the closed-fist stance of neighboring Italy to the construction of a border wall on America’s southern border and the 11.4 million refugees currently awaiting any country to allow them entry.             More than 2 million Iraqi refugees have already fled to neighboring countries since the United States led the invasion of their nation in the spring of 2003, while another 2 million have been displaced within their war-torn country (New York Times).  Currently, the State Department is struggling to keep its promise of admitting 12,000 Iraqi refugees by this September 30, allow that would mean more than 6,000 refugees finding homes in the next 3.5 months.  Towns like Rochester, MN, with a population of only 100,000, have been waiting and preparing for months to receive the 60-70 Iraqi refugees which they have been gratefully assigned.  In speaking with a representative of Catholic Charities Refugee Resettlement, it struck me just how enthusiastic she was to be able to extend a warm welcome to these Iraqi refugees, whose homeland is being destroyed by her own home country. 

            Beyond these self-produced immigration patterns caused by our nation’s myriad “conflicts” (read invasions) over the past 40 years including Korea, Vietnam, Iraq, and Somalia, our nation is simultaneously attempting to address the ongoing issue of illegal migration by erecting a $30-billion border wall.  This Secure Fence was the focus of Time’s most recent cover story, and while the Department of Homeland Security is still attempting to overturn public opposition in Texas in order to complete construction by the end of the year, Time highlighted the fact that the wall is not stopping immigration – it simply changes its form and direction.  While the Border Coalition in the Rio Grande Valley is suing DHS Secretary Michael Chertoff for seizing land unjustly, Stanford historian David Kennedy notes “the difference in per capita income between the U.S. and Mexico is among the greatest cross-border contrasts in the world,” and therefore the push factor of immigration will only be bottled up by a wall rather than stopped.  As residents of on the Texas border currently try to oppose the construction of this last portion of the fence, we as taxpayers and voting citizens must clamor for real immigration reform that addresses the deeper issues of skewed quota systems, the lack of legal paths to earned citizenship, and lopsided international relations.

            In other parts of the world, this same closing of borders is taking place as well, albeit not in the monstrosity of a physical wall.  In Italy, for example, a law was proposed recently by Prime Minister Silvio Berlusconi to make it a felony to enter Italy illegally.  This would jeopardize the thousands of extralegal immigrants currently employed in burgeoning markets such as home health-care for Italy’s aging population.  Berlusconi has not yet heeded the advice of Welfare Minister Maurizio Sacconi who campaigned to legalize some of the 405,000 extralegal residents who filed for adjustment of status last December (New York Times)

            Far from being a lone actor on the global stage, Berlusconi is taking his cues from the E.U.’s shocking new legislation passed last week which would allow extralegals to be detained for as long as 18 months pending deportation.  This shift in philosophy for the European Union is one step closer to dehumanizing immigrants, and paves the way for even more uncompassionate and unjust legislation such as Berlusconi’s recipe for mass arrests.  In the United States, whose extralegal domestic population equals the number of worldwide refugees under the care of the United Nations High Commissioner of Refugees (New York Times), the Supreme Court just ruled that it was illegal for the United States to continue holding detainees as “enemy combatants,” without rights or appeals, as it has done since 9/11 (New York Times).  Today, the U.S. Court of Appeals ruled in favor of Guantanamo Bay detainee Huzaifa Parhat, hopefully bringing an end to the more than six years he has spent in this prison camp without hope of appeal or habeus corpus.  While it has taken more than six years for the U.S. government to finally amend its unjust policy of detaining individuals without appeals in places like Guantanamo Bay, this has not yet been extended to the dozens of immigrant detention centers cropping up in places like Hutto, Raymondville, Port Isabel, or the Ramsey County Center.  Though Europe’s move to detain immigrants is surely a sad shift, this shift happened years ago in the United States and more centers are being built every year to capitalize on the multi-million dollar industry. 

            Immigration has been occurring ever since Adam and Eve emigrated from that Garden so long ago.  How we choose to integrate our fellow man into our own home bespeaks much about ourselves and the future of our society.  Let us pray the future is not one of walls and prisons, detentions and displaced persons.

The Difference between the Dalai Lama and a Satyagrahi

    After 68 years of leading the Tibetan people from his place of exile, the Dalai Lama is the “most seasoned ruler on the planet.” A recent article in Time magazine entitled “A Monk’s Struggle” details the Dalai Lama’s life and his current struggles to free his government from Chinese rule. Though he he has campaigned the world over and is a popular dignitary at universities, capitols, conferences, and celebrations, he hasn’t managed to make significant progress in the past 50 years – “98% of Tibetans have no access to their leader and are denied the most basic of freedoms.”

    To analyze the Dalai Lama’s philosophy and strategy is to explore the fundamental difference between pacifism and nonviolence. Both pacifism and nonviolence are based on the same idea of interconnectedness. “China and Tibet will long be geographic neighbors,” the Dalai Lama intimates, “so for Tibetans to think of the Chinese as their enemies – or vice versa – is to say they will long be surrounded by enemies. Better by far to expunge the notion of “enmities” that the mind has created” (Iyer, Pico. “A Monk’s Struggle, p. 48). A Hindu leader in the country which now protects the Dalai Lama once phrased this same idea by saying, “In the dictionary of the non-violent there is no such word as an external enemy. But even for the supposed enemy he will have nothing but compassion in his heart” [Gandhi, Mohandas. Non-Violent Resistance (Satyagraha)]. An ocean away from both these men, a young pastor was preaching much the same idea around 1959, the year the Dalai Lama was first exiled. He said, “We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly” (King, Martin Luther. Why We Can’t Wait).

    Although based on the same idea of life’s interconnectedness, there is a world of difference between a Satyagrahi and a pacifist. A pacifist looks at the idea of human interconnectedness and concludes that nothing he/she can do could better the situation. The choice of a pacifist is to withdraw support from such a system, hoping that their single vote will eventually cause the aggressor or oppressor to yield to reason. However, the pacifists’ viewpoint does not take life’s “network of mutuality” to its natural conclusion. If all life is connected, then “injustice anywhere is a threat to justice everywhere;” the oppressor is living in an unjust world every bit as much as the oppressed. Gandhi maintains that a victory for Justice is a victory for everyone involved, though at first the oppressor might not view it as such. A pacifist, then, sees the interconnectedness of life and asserts that he/she must remove themselves from the circle of action; the nonviolent Satyagrahi sees the interconnectedness and realizes that he/she must impact Justice for the good of the world.

    Pacifism has long been attacked as “passivism,” and too often nonviolence has been lumped in as well because of its similar aversion to violence. Nonviolence, however, is a pro-active response rather than an acquiescence. Nonviolence is diametrically difference than “not violence” – it chooses pro-active methods such as boycotts, sit-ins, marches, freedom rides, etc, to prick the conscience of its oppressor and anyone watching. There is nothing passive about nonviolence.

    As Dr. King wrote in Why We Can’t Wait, “Fortunately, history does not pose problems without eventually producing solutions….Nonviolent action, the Negro saw, was the way to supplement – not replace – the process of change through legal recourse. It was the way to divest himself of passivity without arraying himself in vindictive force…” (36) The beauty of nonviolence is that it offers a a third way; instead of self-defeating violence or an acquiescence condoning evil and injustice, nonviolence offers a way to save the oppressed from cynicism or inaction and provides a means for redemption for the oppressor. I pray, indeed the whole world prays, that Tibetans and other oppressed peoples throughout the world will be able to bring about Justice through positive, nonviolent means; the Justice of us all depends on their choice today.

Time Ripens

    It is 4:40 on Monday afternoon. We are already ten minutes late as our caravan heads down Monsees Road to Calle Milpa Verde Street in Southmost. Southmost is a community unto itself in Brownsville – students from this area will answer “Southmost” instead of “Brownsville” if they are asked where they live. The 6 of us are driving these pot-holed streets and close communities because Southmost, like so many other communities along the Rio Grande Valley, is slated to have a border wall before the end of the year.

    We drive by the home of Rusty Monsees, one of but a few landowners on the river who is for the wall. In a February 2 article in the Brownsville Herald, Mr. Monsees said he wanted a wall behind his land to stem the drug-running he has witnessed, although he does not seem to mind the occasional immigrant family crossing, people he refers to endearingly as la gente. Mr. Monsees was such a proponent of the wall that he called the United States’ government to ask them to build the wall in his backyard, with one caveat – he insisted there be a gate in the Secure Fence to afford him access to the river.     The road wends its way past the Monsees, up and over the levee which could stand to be a few feet higher at this point. We make our way down Calle Milpa Verde, talking with local landowners, kids, students, dads, teen mothers, grandmothers, aunts, renters, gardeners. Mr. Garcia alerts us that a government agent just visited his house a half hour ago; perhaps if we had not been late, maybe if time had slowed him up and sped up our efforts, we would have been there when the U.S. government man was there asking Mr. Garcia to waive the rights to his property. As it is, we are fortunate – Mr. Garcia has already been in contact with Texas Rio Grande Legal Aid.

    Not everyone on Milpa Verde and San Eugenio Streets, though, is as knowledgeable about the federal designs for their property. One old woman has never heard of a muro before, and it is all we could do to make her believe that the government wanted to erect an 18-foot wall on the 8-foot levee behind her tiny house. Other families have signed but are now having second thoughts. Some want to fight it, but thought it would be prohibitively expensive until they realized that several law firms have pledged to do this work pro-bono.

    As kids run around, flour tortillas sputter and sizzle in the pan, and barbecue wafts through this tight-knit community, we continue to speak with over 150 people. A group of elementary-age children gets so excited about fighting the border wall that they take off on their mountain bikes, distributing 40 leaflets to their neighbors in a veritable “race towards awareness.” We smile at their passion and their instant sense of indignation at the immorality of a border wall through their lives.

    While some individuals bring up the opinions of Monsees, all agree that a border wall would not solve the problems. Far from merely handing out neon-green flyers, this time is meaningful in that it gives all of us updates and perspectives from the “ground.” Even though I live in Brownsville, it is still about 2 miles from the prospective border wall; it is amazing to hear their unique perspectives, their ideas about what solutions would really work, their brainstorms about better ways to spend $49 billion. By the end of the evening, every single one of us wonders if the government even asked the advice of any of these people. We even register three new voters, so at least the government will have the opinions of three more landowners in the upcoming November election.

    Time flies when you are meeting new people and talking about an issue dear to your heart. As encouraging as these few hours were, it is daunting to realize that this must happen in every community all along the 120 miles of the Rio Grande Valley. It will take at least two more trips to Southmost to flyer every single house on the levee, and the government is certainly not waiting patiently as we organize. Despite the semi-favorable court decisions the last few weeks, the U.S. government still is adamant about pursuing the Secure Fence Act of 2006. The opposition to the wall is growing in purpose and in numbers, but we must press on. As Martin Luther King, Jr. wrote in Why We Can’t Wait,

Human progress never rolls in on wheels of inevitability; it comes through the tireless efforts of men willing to be co-workers with God, and without this hard work, time itself becomes an ally of the forces of social stagnation. We must use time creatively, in the knowledge that the time is always ripe to do right. (86)

The border wall is not an inevitable reality, but neither is a successful overturning of this federal legislation. To that end, people on all borders and immigrants of all ethnicity and background must join this effort to oppose a border wall and demand the immigration reform every U.S. resident so desperately needs. Time is only on our side if we are doing something meaningful for a cause in which we believe. The time is right, and ripens everyday.
